Welcome to Safimel. These Terms and Conditions govern your use of our website and the purchase of products from www.safimel.co.uk ("the Website").
By accessing the Website or placing an order, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this Website.

1. About Us
Safimel is an online retailer of jewellery, gifts, collectables, home décor, fantasy merchandise, gothic products and licensed collectibles from leading brands including, but not limited to:

• Alchemy England

• Alchemy Gothic

• Anne Stokes

• Lisa Parker

• Nemesis Now Studios

• Other manufacturers and licensors featured on our website.

Throughout these Terms, "Safimel", "we", "our" and "us" refer to Safimel.
 
2. Website Use
You agree to use this Website only for lawful purposes.
You must not:

• misuse or attempt to compromise the Website;

• interfere with its operation or security;

• copy or reproduce Website content without permission;

• submit false or fraudulent orders.

We reserve the right to suspend or terminate access to the Website at any time.

3. Product Information
We work hard to ensure all descriptions, images and prices are accurate.

• dimensions are approximate unless stated otherwise;

• packaging may differ from images shown;

• manufacturers occasionally alter products without notice.

Many branded products, including Nemesis Now and Alchemy England items, are supplied using manufacturer descriptions and photography.

4. Product Availability
All products are offered subject to availability.

If this happens after payment has been taken, a full refund will be issued.

5. Prices
All prices are displayed in Pounds Sterling (GBP).
Prices include UK VAT where applicable.
Delivery charges are calculated during checkout.
Although we make every effort to ensure pricing accuracy, obvious pricing errors may occur.
Where a genuine pricing error exists, we reserve the right to:

• cancel the order before dispatch;

• offer the customer the opportunity to purchase at the correct price;

• issue a full refund.

6. Orders
When you place an order you are making an offer to purchase goods.
Your order is accepted only when:

• payment has been authorised; and

• we send a Dispatch Confirmation email.

Until goods are dispatched, no legally binding contract exists.
We reserve the right to decline any order.
Reasons may include:

• stock shortages;

• payment failure;

• suspected fraud;

• shipping restrictions;

• pricing errors;

• product withdrawal;

7. Payment
We accept payment using the methods shown during checkout.
Payments are securely processed through our payment providers.
Safimel does not store full payment card information.
Orders will not be dispatched until payment has cleared.

8. Delivery
Estimated delivery times are provided as guidance only.
Delivery delays caused by:

• Royal Mail

• couriers

• customs

• weather

• industrial action

• force majeure

are outside our control.
Risk passes to the customer upon delivery.
Ownership transfers only after full payment has been received.

9. International Orders
Customers are responsible for any:

• customs duties;

• import taxes;

• local handling fees;

• import restrictions.

Safimel cannot be held responsible for goods delayed or refused by customs authorities.

10. Right to Cancel
Consumers purchasing online have statutory cancellation rights under the Consumer Contracts Regulations.
Unless an exemption applies, you may cancel your order within 3 days after receiving your goods.
To exercise your cancellation rights, simply contact us with your order number.
Returned goods must:

• be unused;

• be in their original packaging;

• include all accessories;

• be suitable for resale.

Customers are responsible for return postage unless the item is faulty or incorrectly supplied.
Refunds will normally be processed within 14 days after receiving returned goods.

11. Faulty or Damaged Goods
Please inspect your order promptly after delivery.
If goods arrive:

• damaged;

• faulty;

• incomplete;

• incorrect,

please notify us as soon as reasonably possible and preferably within 48 hours.
This does not affect your statutory rights.
Where appropriate we may request photographs before arranging replacement or refund.
If goods are confirmed to be faulty, we will:

• replace them;

• repair them where appropriate; or

• issue a refund.

Return postage for faulty goods will be reimbursed where applicable.

12. Returns
Items returned because the customer has changed their mind must:

• be unused;

• remain in saleable condition;

• include original packaging;

• include all labels and accessories.

For hygiene reasons, pierced jewellery and certain personal items cannot be returned unless faulty.
Custom-made, personalised or special-order goods cannot normally be cancelled after production has commenced.

13. Manufacturer Warranties
Some products supplied by manufacturers including Nemesis Now and Alchemy England may include their own manufacturer warranty.
Where applicable, these warranties are provided in addition to your statutory rights.

14. Product Safety
Many of our products are intended for decorative purposes.
Unless specifically stated otherwise:

• they are not toys;

• they are unsuitable for young children;

• some items contain sharp edges, glass or fragile materials.

Please follow all safety instructions supplied with the product.

15. Intellectual Property

• graphics;

• logos;

• product descriptions;

• photography;

• branding;

is owned by Safimel or its licensors.
Brand names including Nemesis Now and Alchemy England remain the property of their respective owners.

16. Limitation of Liability
Nothing in these Terms limits liability where it would be unlawful to do so, including liability for:

• death or personal injury caused by negligence;

• fraud;

• fraudulent misrepresentation;

• statutory consumer rights.

Subject to the above, Safimel shall not be liable for:

• indirect losses;

• loss of business;

• loss of profits;

• loss of data;

• consequential losses arising from use of the Website or products.

Our total liability shall not exceed the purchase price of the goods concerned.

We shall not be liable for delays or failures caused by circumstances beyond our reasonable control, including but not limited to:

• severe weather;

• pandemics;

• industrial disputes;

• courier failures;

• supplier shortages;

• cyber attacks;

• governmental action;
